{"id":3,"date":"2019-06-30T15:00:31","date_gmt":"2019-06-30T14:00:31","guid":{"rendered":"http:\/\/smtcontracts.co.uk\/?page_id=3"},"modified":"2020-01-19T16:17:11","modified_gmt":"2020-01-19T16:17:11","slug":"privacy-policy","status":"publish","type":"page","link":"https:\/\/smtcontracts.co.uk\/index.php\/privacy-policy\/","title":{"rendered":"Privacy Policy"},"content":{"rendered":"<p><strong>Policy background:<\/strong><\/p><p>In\nthis policy we have set out the personal data that we collect from, and about,\nour customers and we explain how this data is used and why we need it.&nbsp; It is important to note that this policy is\nnon-contractual.<\/p><p>We\nare committed to protecting the personal data that we have access to, and are\nrequired to have, in order to process orders for our products and services, and\nhave therefore developed privacy policies to protect such data.&nbsp; This particular policy relates to all of the\npersonal data held about our customers.<\/p><p><strong>What is personal data?<\/strong><\/p><p>Personal\ndata is any information relating to an identified, or identifiable, individual,\nthat could lead to them being treated differently. This may include your name,\naddress, telephone number and email address.&nbsp;\nWe may also hold any other information that is necessary for our\nbusiness purposes and to administer your purchases.<\/p><p><strong>What personal data do we process and\nwhere does it come from?<\/strong><\/p><p>We\ngenerally only collect and use personal data from individuals when they\npurchase goods or require services from us. The data processed includes, but is\nnot limited to, your name, address, telephone number and email address.&nbsp; This data is collected directly from\nyou.&nbsp; We do not collect data from third\nparties.&nbsp; This data is stored securely in\nour systems, in emails and in our paper files.<\/p><p><strong>Why do we collect personal data?<\/strong><\/p><p>Our\nlawful reason for collecting and processing your data is to carry out our\nlegitimate business interests, because we need to process this data in order to\ncarry out our obligations under the contract of purchase and supply, or because\nwe need to comply with a legal obligation.<\/p><p>Without\nyour personal data we cannot administer your purchase request properly and consequently\ninitiate a successful purchase or service supply process.&nbsp; We may use your personal data without your\nknowledge or consent, where we are permitted or required by law, or regulatory\nrequirements, to do so \u2013 for example, the supply of data to HMRC.<\/p><p><strong>What do we do with personal data?<\/strong><\/p><p>We\nuse personal data specifically for business purposes including facilitating the\nsupply of customer orders.&nbsp; We need to be\nable to process your order, supply your service, maintain accurate business\nrecords and undertake any other reasonably related purpose in carrying out our\nbusiness activities.<\/p><p><strong>Monitoring, disclosing and sharing\npersonal data:<\/strong><\/p><p>As\npart of our customer contract we monitor compliance with other policies, such\nas our IT policy, which safeguards our systems and ensures that data is deleted\nas soon as we are required to do so.&nbsp; We\ndo not share with or disclose personal data to anyone other than such parties\nthat we are legally required to do so (such as HMRC).<\/p><p><strong>How long will we keep personal data for?<\/strong><\/p><p>There\nare existing legal and regulatory requirements which govern how long we should retain\nyour personal data, which may change at any time.&nbsp; HMRC currently require business records to be\nkept for 6 years, after which period the GDPR requires that personal data is\ndestroyed.<\/p><p>In\ngeneral we will keep sales enquiry data for up to 6 months after the initial order\nprocess is completed, after this period data will only be kept that ensures\nthat the statutory requirements in force at the time are adhered to.<\/p><p><strong>The rights of individuals whose personal\ndata we process:<\/strong><\/p><p>If\nwe are processing your personal data you have the following rights:<\/p><ol class=\"wp-block-list\"><li>The right to be\ninformed of what data we are processing, what for, how we obtained the data,\nand to whom it is being released.<\/li><li>Subject to\ncertain conditions as set out in \u201cAccess to your personal data\u201d below, the\nright to access the data that we are processing on you.<\/li><li>The right to\nrectification of the data if it is seen to be incorrect or inaccurate.<\/li><li>The right of\nerasure (in certain circumstances such as where you gave your consent to\nprocess).<\/li><li>The right to\nrestrict processing (to request that we do not process data for certain\nactivities in certain circumstances).<\/li><li>The right to data\nportability (where appropriate).<\/li><li>The right to\nobject.<\/li><li>The right not to\nbe subject to automated decision making.<\/li><\/ol><p><strong>Access to personal data:<\/strong><\/p><p>You\nhave the right to see the personal data that we hold about you.&nbsp; Any such request must be made in writing or\nby email.&nbsp; When requesting access to your\npersonal data, please note that we may request specific information from you to\nenable us to confirm your identity, and the right that you have to access the\ndata, as well as to search for and provide you with the personal data that we\nhold about you.&nbsp; We will ensure that your\nrequest is responded to within one month of receipt.&nbsp; Your right to access the personal data that\nwe hold about you is not absolute.&nbsp; In\nthe event that we cannot provide you with access to your personal data, we will\nendeavour to inform you of the reasons why, subject to any legal or regulatory\nrestrictions.<\/p><p><strong>Updating personal data:<\/strong><\/p><p>It\nis important that the data we process about you is accurate and up to\ndate.&nbsp; Whilst we endeavour to ensure that\nit is at the time we first collect it, we need you to ensure that you keep us\nupdated when the personal data that we hold about you changes.<\/p><p><strong>Keeping personal data safe and secure:<\/strong><\/p><p>We\nseek to maintain physical, technical and procedural safeguards that are appropriate\nto the sensitivity of the personal data in question.&nbsp; These safeguards are designed to protect your\npersonal data from loss, unauthorised access, copying, use, modification or\ndisclosure.&nbsp; We maintain policies and\nprocedures and design our IT systems that process personal data based on a\nPrivacy by Design principle.&nbsp; We have\npolicies in place to deal with a suspected data security breach and will notify\nthe Information Commissioner\u2019s Office (ICO), and you, of any suspected breach\nwhere we are legally required to do so.<\/p><p><strong>Transferring personal data outside of\nthe European Economic Area (EEA):<\/strong><\/p><p>We\nwill not transfer your personal data to countries outside the European Economic\nArea (EEA).<\/p><p><strong>Questions or concerns:<\/strong><\/p><p>If\nyou have any questions about this privacy policy, or any concerns about how we\nmanage your personal data, please contact us in writing or by email.&nbsp; We will seek to answer your questions and\nadvise you of any steps taken to address any issues raised.&nbsp; If you are unsatisfied with our response, or\nyou believe that we have not complied with your data protection rights, you may\nmake a written submission to the Information Commissioner\u2019s Office (ICO).<\/p><p><strong>Changes to our privacy policy:<\/strong><\/p><p>Any\nchanges we may make to our privacy policy in the future will be posted on this\npage.&nbsp;
